Terms of Service

1. Who we are

Dreamsmore AI ("we", "us", "the Platform") is operated by DREAMS & MORE GLOBAL TECHNOLOGIES LIMITED, registered in the State of Delaware, United States, and serving clients since 2005.

By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy.

2. What the Platform does

Dreamsmore AI lets you generate AI videos, business ad commercials, multi-scene video stories, and flyer designs from text prompts, using third-party AI generation providers (currently fal.ai). Generated output is produced by machine-learning models and may be imperfect, unpredictable, or occasionally fail. See Section 6 on credits and refunds.

3. Accounts

You must provide accurate information to register and must be at least 18 years old (or the age of majority in your country, if higher). We do not knowingly allow anyone under 18 to use the Platform. You're responsible for keeping your password secure and for activity that happens under your account. Tell us immediately if you suspect unauthorized use.

4. Acceptable use

You agree not to use the Platform to generate, upload, or share content that:

• Is illegal, defamatory, harassing, or infringes someone else's rights (including intellectual property, privacy, or publicity rights);
• Depicts real, identifiable people without their consent, including non-consensual intimate imagery or deceptive impersonation ("deepfakes");
• Promotes violence, self-harm, hate, or exploitation of minors;
• Is used for spam, fraud, or to mislead others (e.g. fake advertising, scams);
• Attempts to abuse, overload, reverse-engineer, or circumvent the Platform's rate limits, credit system, or security.

We may remove content, suspend, or terminate accounts that violate this section, with or without notice. Publicly visible creations may be reported by other users and reviewed by our moderation team.

5. Ownership of generated content

As between you and us, you own the output you generate, subject to (a) the underlying AI provider's own terms and any rights of third parties depicted or referenced in your prompt, and (b) our right to remove content that violates Section 4. You're responsible for making sure you have the rights to use any names, logos, likenesses, or copyrighted material you include in a prompt.

6. Credits, payments, and refunds

• Generation uses credits, purchased in packs via Paystack or granted as a signup bonus.
• Credits are deducted once a generation job is successfully submitted. If a job later fails during processing, the credit(s) for that job are automatically refunded to your account.
• Purchased credit packs are generally non-refundable once credits have been issued, except where required by law or at our discretion (e.g. a duplicate or clearly erroneous charge).
• Credits have no cash value, cannot be transferred between accounts, and may expire if your account is closed or terminated for violating these Terms.
• Prices, credit costs per generation, and available packs may change at any time; changes do not affect credits you already hold.

7. Service availability

The Platform depends on third-party AI infrastructure (fal.ai) and payment infrastructure (Paystack) that we don't control. We don't guarantee uninterrupted availability, specific generation speed, or that any given prompt will produce a usable result.

8. Disclaimers and limitation of liability

The Platform and generated content are provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Platform, or for the accuracy, legality, or fitness for purpose of AI-generated output. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.

9. Termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate accounts that violate these Terms, engage in fraud or abuse, or as required by law.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above; continued use of the Platform after changes take effect means you accept them.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
